Probate on 5 Apr 1842 in Lexington, Davidson, NC. 2 State of North Carolina Davidson County To Spring Term 1842 In Equity To the Honorable the Judge of the Court of Equity in and for said County The Petition of Isaac Thompson, William Thompson, Andrew Thomson & James Thompson against Isham Thompson, Peggy Thompson & Polly Grice, Fredrick Thompson, Peggy Thompson & Sally Morris Humbly Complaining your Petitioners Respectfully There unto your Honor that there father William Thompson Sr. departed this life in this County in the month of December 1841 Intestate and was at his Death Seized & possessed of 525 acres of land in four tracts all adjoining each other whereon he lived, said lands adjoining the lands of Hiram Ward & others and on the waters of Cabin Creek in said County that said William Thompson Sr. left no widow but left the following persons his Children and Grand Children who are his heirs at law ( to wit ) your petitioners Isaac Thompson, William Thompson Jr. & James Thompson and the Defendants Peggy Thompson who resides in the State of Kentucky, Sally who intermarrying with Isham Wallace & who reside in Kentucky - Polly Grice Widow of Isaac Grice Dcd. who resides in this County & Fredrick Thompson & Peggy Thompson, Grand Children being the Children of John Thompson decd. who died before his father the said William Thomson Sen. and Grand Child Sally Morris infant Child of Betsy and William Senn Daughter who had intermarried with John Morris & Decd. before said William Thompson. Said Fredrick Thompson & Peggy Thompson reside in Kentucky and Sally Morris is a minor in this County without any regular Guardian. Your petitioner would show unto your Honor that said tract of land cannot be divided among the said Heirs without injury to the interest of all concerned and they would further show that a sale of said land would be of advantage to all interested and materially promote the interest of the infant Sally Morris. Your Petitioners therefore pray your Honor to Decree a sale of said 525 acres of land upon some Reasonable Credit and that the Clerk and Master sell the same and that the proceeds of sale be divided among your petitioner and the defendants as they may be respectfully entitled to as next of kin & heirs at law of said William Thompson Sen. Decd. and that the interest of the infants & same coverts duly secured. Your petitioners pray that the said Isham Thompson Sen. Peggy Thompson Sen. Polly Grice Fredrick Thompson Peggy Thompson Jr. & Sally Morris be made party defendants to this petition and that a copy thereof with process issue and be served upon such of them as they are in this State and that Publication be made as to those who are out of the State and that a guardian be appointed for Sally Morris the infant. And your Petitioners pray your Honor for such other and further relief in the premises as the nature of their case may require and to you may be just and right and your Petitioners as in duty bound ever pray.
Research Note: Cabin Creek runs south of and parallel to Lick Creek Church Road and north of the village of Jackson Hill in southern Davidson County. Other records show "Jackson Hill" as the location for the elder William Thompson. .

On 2 Sep 1843 in Jackson Hill, Davidson, NC, United States. 3 No. 99 County: Davidson Name: William Thompson Acres: 5 39/100 Grant No. 98 Issued 2 Sept 1843 Entry No. 248 1/2 Entered 10 Jan 1843 Book No. 149 Page 1 Location: On waters of Cabin Creek ======= State of North Carolina Davidson County To the Surveyor of said county You are hereby required to survey according to law for William Thompson the following entry to wit No. 248 1/2 on the waters of Cabbin Creek adjoining Oliver Glover & others, entered the 10th day of January 1843. State of North Carolina Davidson County No. 248 1/2 I hereby certify that William Thompson entered 10 acres of land in the entry taker office on the 10th day of January 1843 Ch. Mock ========== State of North Carolina: By virtue of a warrant No. 248 1/2 dated 10th January 1843 surved for William Thompson a tract of land lying in Davidson County on the waters of Cabin Creek beginning at a white oak Andrew Thomson's corner then west eleven chains & twenty links to a pine stump then south 28 degrees west four chains & sive five links to a post oak then east fourteen chains & twenty links to a stake then to the beginning containing five acres & 29 hundreths. Surveyed 29th March 1843 by Oliver Glover & Jacob Gafs.
3. William Thomson (son of William Sr.) assigns his brother James's son, William, power of attorney. On 11 Dec 1843 in , Stanly, NC. 1 Power of Attorney William Thomson Sr. To William Thomson (of James) To all people to whom these presents shall come I, William Thomson Sen. of the County of Stanly of North Carolina one of the Heirs of William Thomson Deceased send greeting - Whereas William Thomson died in December 1841 seized of or possessed of an Estate lands which was by a decree of the Court of Equity ordered to be sold by the Clerk and Master in Equity and an equal division to each heir made, Now know ye, that I William Thomson have made constitute and appointed, and by these presents do make, constitute and appoint William Thomson ( son of James ) of the County of Davidson and State aforesaid my true and lawful Attorney, for me ,and in my name, and for my use, to demand, sue for and recover and received of Wilson Womach the said Clerk and Master in Equity aforesaid or in whose hands soever the same may be found, the said legacy or proportionate share, and also all such, other sum or sums of money, debts, goods, wares, and demands whatsoever, which are or shall be due, owing, payable and belonging, to me, by any means whatsoever of account of my full share, part and dividend of the Estate aforesaid and to give discharges therefor, I hereby ratifying and confirming all the acts of my said attorney, or of his substitutes done by virtue of, and in pursuance of these presents. 4. Census in 1850 in , Stanly, NC. 4 The 1850 census recorded in Truman District No. 2: William Thompson, laborer, 71, living Elizabeth, 56, and granddaughter Jemima, 12. William was born in New Jersey and the others in North Carolina. Next door is Moses Thompson, farmer, 36, living with Sarah A., 19; Eliza, 10; Robert, 6; James F., 3; and John S., 7 months old when the census was recorded on 7 August 1850.
