Also in the home is Catharine Kinesley, 11. John's land was valued at $5000, a high amount. He and his wife were born in Maryland and their children in Indiana. Kinesley was born in Ohio.

The following cases were decided Saturday, February 19, 1881:
SUIT TO QUIET TITLE
7105. Isaac N. Talbott vs. John C. Hale. Tippecanoe Circuit Court. Reversed. Niblack, C. J.
Suit by Isaac N. Talbott against John C. Hale and Charles Hale, to recover the possession of and quiet the title to a certain piece of real estate in Benton county. The court made a special finding on the facts. The land had at one time been sold at sheriff sale on a judgment with relief from valuation and appraisement laws. Among other things the special finding was that the land was sold without first being appraised.
(1.) So much of the special finding as asserts that the land in suit was sold without appraisement was not sustained by any evidence, either oral or written. The return of said sheriff to the execution upon which the sale was made did not state whether or not the land was appraised before it was sold, and nothing was disclosed on that subject by any of the other evidence at the trial.
(2.) The regularity of the proceedings by the sheriff should have been presumed, in making the special finding, until the contrary was shown.
(3.) It devolved upon the party attacking the sheriff's sale, to show in some way that there had been no appraisement.
