4. Indenture: 13 Aug 1817, in Codorus Twp., York, PA. 8 In simple terms, Peter Beecher temporarily conveyed his land to Christian Cashman as collateral because Cashman guaranteed Beecher's debt to Peter Klinefelter. If Beecher pays the debt in full, the land ownership reverts to Beecher. If Beecher defaults, Cashman could claim the land to cover the money he would then owe.
The agreement was between Peter Beecher (of York County, Pennsylvania) and Christian Cashman (of Adams County, Pennsylvania).
The Debt/Obligation: Peter Beecher owed money to Peter Klinefelter (now of Maryland) through fourteen separate bonds/obligations.
Thirteen of the bonds were for $100 each, payable annually on April 1st, starting in 1818.
The final bond was for $33.33, due on April 1, 1831.
Cashman's Role (The Security): Christian Cashman agreed to become security (or guarantor) for Peter Beecher on all fourteen of these obligations. This means Cashman is legally bound to pay the debt if Beecher defaults.
The Security (The Land Conveyance): To protect Cashman from having to pay the debt, Beecher conveyed (or sold) a tract of land to Cashman.
The land is 130 acres and 100 perches in Codorus Township, York County, Pennsylvania.
The transfer includes all buildings and improvements.
The Condition of Redemption (The Mortgage Clause): The conveyance of the land to Cashman is not permanent, but is "Subject nevertheless to the provise or Condition of Redemption." This is the key condition that makes it a security agreement:
If Peter Beecher fully and truly pays all fourteen obligations to Peter Klinefelter when they are due, and
If Beecher saves Christian Cashman "harmless and Indemnified" (meaning, he doesn't have to pay anything and is not liable for any costs or damages),
Then the indenture and the estate (the land) granted to Cashman "shall cease and become absolutely null and void."

6. He signed a will on 26 Feb 1844 in Mount Pleasant Twp., Adams, PA. 10 In the name of God Amen, I Christian Cashman of Mount Pleasant Township Adams County State of Pennsylvania, being in good health of body and of sound and disposing mind, and being desirous to settle my worldly affairs whilst I have strength and capacity to do so, do make and publish this my last will and testament, hereby revoking and making void all former wills by me at any time hereto made and first and principally, I commit my soul into the hands of God my Creator, and my body to be decently buried at the direction of my herein after named Executors and as to such worldly estate wherewith it pleased God to intrust me with, I dispose of the same in the following manner, I do order and direct that my herein after named executors shall sell all my household and kitchen furniture and other personal property not hereinafter bequeathed as soon after my decease as the conveniently can and the proceeds thereof, to be applied to paying my just debts and funeral expenses.
Item I give and bequeath unto my son John Cashman the farm I now own and live on, and all the stock and farming utensils I now own and all the shares of stock I now own in the York and Gettysburg Turnpike Company.
Item I do order and direct that my son John Cashman shall pay at the end of three years after my death the following legacies in the following manner.
Item I give and bequeath unto my daughter Sally Cashman the sum of five hundred dollars.
Item I give and bequeath unto my daughter Lydia Cashman the sum of four hundred dollars.
I give and bequeath unto my daughter Ann intermarried with Philip Essick the sum of three hundred dollars.
I give and bequeath unto my daughter Margaret intermarried with William Sloniker the sum of three hundred dollars, and where I hold a judgment against William Sloniker on the docket of Samuel Cadwell Esq. and now in the hands of A. King. Esq. which said judgment to be deducted out of the legacy bequeathed to my daughter Margaret intermarried with said William Sloniker. the residue of the legacy bequeathed by me to my said daughter Margaret intermarried with William Sloniker I direct to remain in the hands of my Executors they paying the interest thereof yearly as the same or any part thereof may become due, unto her own hands and in no other way or manner whatever, and no other voucher but such as she shall give from her own hands, shall ever discharge my executors from the payment of the money, her present husband William Sloniker shall have no authority or control over her Estate or interest hereby given her and in case she survives the William Sloniker I direct her whole share to be paid to her, but in case her husband survives her then her legacy is to be paid to her children or the Guardian of such of them as shall be minors.
I give and bequeath unto my daughter Mary intermarried with George C. Strickhouser the sum of three hundred dollars and the said legacy is to be paid to my said daughter Mary if she is alive when her said legacy becomes (due) and if she should die before it is due then I order and direct that her said legacy is to be paid to her son Jacob Strickhouser to be equally divided among her heirs.
I give and bequeath unto my daughter Susan intermarried with Peter Trostle the sum of two hundred sixty dollars.
I give and bequeath unto my daughter Catherine intermarried with Peter Beecher the sum of one dollar.
And it is my exposed will that the foregoing legacys are to be paid in the following manner, by my son John Cashman at the end of three years after my death. Beginning with Sally and Lydia is each to receive the sum of seventy five dollars at the end of three years after my death and the like sum of seventy five dollars each year thereafter until the legacies are paid, and after the two above mentioned heirs are paid then Ann intermarried with Philip Essick and Margaret intermarried with William Sloniker is each to receive the sum of seventy five dollars until their legacies are paid, and when the two last mentioned heirs are paid the Mary intermarried with George C. Strickhouser and Susan intermarried with Peter Trostle is each to receive the sum of seventy five dollars yearly until their legacy is paid, and then Catherine intermarried with Peter Beecher is to receive the sum of one dollar, and after the above legacys are paid, then it is my will that my grandson Jacob Strickhouser is to receive the sum of one hundred dollars, one year after the last legacy is paid, and after the above legacy then I give and bequeath unto my grand daughter Mary Bercaw the sum of one hundred dollars, in one year after the above legacy is paid and she is further to receive one cow, one bed and bedding and one spinning wheel, and one year after the last legacy is paid I order and direct that my grand daughter Sophia Beecher is to receive the sum of one hundred dollars, one cow one bed & bedding and one spinning wheel, and I also order and direct that after my funeral expenses are paid that my executors shall out of the first monies that come into hands procure two pair of grave stones, one pair to be placed at my grave, and the other pair to be placed at the grave of my deceased wife, and in case my son John Cashman should not be able to meet all the above legacys and other debts that I owe, I then order direct my said executors as soon as they conveniently can for to sell about eighty acres opposite. from the north part of my farm on which are erected a two story frame dwelling house log stable etc. adjoining lands of Daniel Comfort, Nicholas Moritz, Ralph Ficks and others, and it is expressed will that any of my heirs setting up any claim against my estate after my decease for services rendered, shall forfeit all their interest therein given to them and their shares shall be equally divided among them who are satisfied, and lastly I nominate, constitute and appoint my son John Cashman and Thomas McCreary of the Borough of Gettysburg to be the executors of this my last will and testament hereby revoking and making void all other wills, legacys and bequeaths hereto by me made, and declared this and no other to be my last will and testament.
