On the Petition of Jacob Hamman eldest son and heir at Law of Baltzer Hamman late of Whitehall Township in the said County Yeoman deceased Setting forth That the Petitioner's said Father died about nineteen Years ago Intestate leaving a Widow and four Children and being seized & possessed at the time of his death of and in a certain Plantation and Tract of Land situate in Whitehall Township aforesaid and Containing about two hundred acres ... Praying the Court to award an Inquest to make Partition of the said Land into and amongst the Children of the said deceased if Partition thereof can be made without prejudice to & spoiling the whole, And if Partition thereof cannot be made that then the said Inquest may be Directed to Value and Appraise the same And that the Petitioner may be admitted to hold & enjoy the same upon paying or securing to be paid unto the other Children of the said deceased their respective shares of such Valuation according to the Acts of Assembly of this Province in such Case made & provided &c Whereupon it is Considered by the Court and Ordered that a Writ of Partition ... issue out of this Court commanding the Sheriff of the said County….

3. Court: on 22 Jun 1774 in Easton, Northampton, PA. 6 Orphans' Court proceeding from Northampton County, PA, on June 22, 1774, concerning the real estate of the deceased Balzer Hamman.
Valuation: An inquest (jury) determined that the 200-acre plantation in Whitehall Township could not be partitioned among the heirs without "prejudice" or "spoiling" the whole, and they appraised its value at £775 (Pounds) lawful Money of Pennsylvania.
Acceptance: The eldest son, Jacob Hamman, appeared in court and declared his willingness to accept the entire tract at the appraised valuation.
Court Award: The court awarded the land to Jacob Hamman "to be Enjoyed by him his Heirs and Assigns for Ever," and the other children were "forever debarred" from any claim to the premises.
Payment/Shares: Jacob was allowed one year to pay the shares of the other children without interest, secured by two approved individuals (George Knowse and George Staiminger).
Distribution of Estate:
The total valuation of £775 had £11.0.0 deducted for court and sheriff fees.
The Widow's Third (£254.13.4) was established, of which she was to receive the interest yearly.
The remaining balance (£509.6.8) was divided into five shares for the children.
The oldest son, Jacob, received a double share of £200.18.8.
Each of the other children received one share of £101.17.4.

5. Pennsylvania Land Warrants on 23 Jan 1782 in Macungie Twp., Lehigh, PA. 8 The Warrant Register for Northampton County shows in the index #165 Haman, Jacob, Accepted 9.71 acres in Macungie Township on 23 Jan 1782 recorded in Volume P 1 page 166 and survey in Volume C 78 page 225.

Until 1812 when Lehigh County was founded this area in 1782 was part of Northampton County at the time the warrant was issued.

Probate of Jacob Hamman on 22 Apr 1808 in Easton, Northampton, PA. 10 This court record, dated April 22, 1808, from the Orphans Court in Easton, Northampton County, Pennsylvania, documents a petition concerning the estate of Jacob Haman, late a Yeoman of Whitehall Township, who died without a will (intestate).

Tract 1: Approximately 200 acres, adjoining land of Henry Koch, Peter Guth, George Knauss, and others.

Tract 2: Approximately 9 acres, adjoining land of Peter Guth and others.

Court Action Requested & Ordered:
The petitioners prayed for the Court to award an Inquest (jury) to:

Partition the land among Jacob Haman's eight children and representatives according to state law, if such a division could be made without prejudice or spoiling the whole property.

Value and appraise the property if partition was not possible.

The Court granted the petition and ordered a writ to be issued to the Sheriff of Northampton County. The Sheriff was commanded to take twelve "honest and lawful men" (the Inquest) to the property to:

Make a just and true partition under oath or affirmation.

Or, if full partition was not possible, value and appraise the whole.

Or, if the land could accommodate more than one child/representative without being spoiled, divide it into accommodating portions and value/appraise those portions.

The Sheriff and the Inquest were ordered to present their report of the partition or valuation to the Judges at the Orphans Court in Easton on Friday, August 19th next (August 19, 1808).
