SPARTA Fred Hart Jr., 34, State Highway Department worker who was charged with murder in the slaying of Raymond Cleary Sept. 25, has been exonerated following a hearing before Magistrate Glenn Nichols.
The technical murder charge lodged by Sheriff Floyd Roupe following the slaying, was dismissed by Magistrate Nichols who held that Hart was acting in defense of his home. He said it was justifiable homicide.
The brief hearing was held Friday. Sheriff Roupe testified that Cleary shot into an automobile operated by Lemon I. Handy, 21, of McGrady while it was traveling on the Blue Ridge Parkway.
The shot penetrated the trunk and backseat of the car before entering the back of Fred Absher, 19, of McGrady. Absher died instantly.
Handy drove to the home of Hart and sought aid. Hart drove behind Handy to a motel to use a telephone and report the tragedy. They saw Cleary, a wanderer and handyman with a long record, and Cleary raised his rifle as if to shoot.
Hart said he returned to his home, herded his family into a rear room and alerted his brother's family next door. He then got his rifle and hid behind a car.
Cleary approached the Hart home and fired one shot. Hart fired 16 shells from his 22 caliber. Three of them hit Cleary. ?? staggered off and was found later about 125 feet away by Sheriff Roupe. He died about two hours later at Alleghany Memorial Hospital here.

Obituary: Grandview Funeral Home on 16 Jun 2008 in Winston-Salem, Forsyth, NC. 4 Fred Hart, Jr., age 81, of Laurel Springs, died Monday, June 16, 2008, at the Forsyth Medical Center in Winston-Salem. He is survived by his wife, Maxine Neaves Hart of the home; four daughters, Maggie Ann and her husband, Dennie Perry, of Ennice, Diane Poe and her husband, E.J. of Laurel Springs, Cynthia Gail Tompkins and her husband, Steve, of Sparta, Janet June Garvey and her husband, Doug, of Galax, VA.; two sons, Jeffery Fred and Rex Gerald Hart, both of Galax; a brother, Paul Hart and his wife, Peggy of Laurel Springs; two sisters, Syble Caudill of Jefferson, Maxine Pickett and her husband Roger, of Jonesville; seven grandchildren and four great-grandchildren also survive. A graveside service will be conducted at 2:00 pm Wednesday, June 18th at the Transou Methodist Church Cemetery in Ashe County with full military rites by the Bruce Wayne Osborne VFW Post # 7034. The family will receive friends from 1 until 2 p.m. at the Church. Memorials may be made to the Transou Cemetery Fund, c/o Mary Sue Royal, 9000 NC Hwy 88 E. Laurel Springs, NC 28644. Grandview Memorial Funeral Home of Sparta is serving the Hart Family.
