Daniel's son, Joshua Rigle, farmer, 45, is listed nearby with his wife Hannah, 35; son Elias, farm hand, 20; daughters Joanna, 8, and Ann G., 1; and sons Dora, 5, and Joshua, 2 months old born in April 1880. They and their parents were born in Pennsylvania.
10. He signed a will Will Book 5 Page 223 - Will of Daniel Riegel on 3 Nov 1880 in , Schuylkill, PA. 21 In the name of God, Amen. I, Daniel Riegel, of the township of West Brunswick, County of Schuylkill, and State of Pennsylvania, being weak of body, though of sound mind, memory, and understanding, but considering the uncertainty of this transitory life, do make and publish this my last will and testament in manner and form following, to wit:
First, It is my will and I do order, that all my just debts and funeral expenses be duly paid and satisfied as soon as conveniently can be after my decease.
Second, It is my will, and I do order that the "Indenture of Settlement" dated November thirteenth A.D. 1878, made between myself and my present wife, Lydia (late Lydia Weaver) and concluded or duly executed immediately before our marriage, and recorded in the Recorders Office in and for said County of Schuylkill, in miscellaneous Book No. [blank] Page [blank] wherein is secured the interest of two thousand dollars unto my said wife during her natural life, which shall be in lieu for her portion of dower, interest, and the three hundred dollars allowed by the Act of Assembly to widows of decedents. I also give and bequeath unto my said wife my twenty four hour mantle clock.
Third, I give and bequeath all my property, personal, real and mixed estate to my children and their heirs, said estate to be divided in twelve equal shares, the several amounts of money which my children received of me during my lifetime shall be deducted from their respective shares.
Fourth, It is my will, and I do order that no interest shall be added to the principal sums of money that my sons Eli (one hundred dollars), Daniel (Fifty dollars) and Reuben (Two hundred and Sixty dollars) received of me, but that the remainder of my children who received money of me shall pay interest upon their respective notes and bonds as they demand.
Fifth, I give and bequeath unto the "Church of God" located near the farm of the "German Eldership, in Schuylkill County," (known as the Kimmel's meeting house) Fifty Dollars, which shall be appropriated to the repairs of the said church and cemetery attached thereto.
Sixth, It is my will and I do order that if it is necessary my hereinafter named Executor shall have five years time to settle up my said estate, and I further order that tombstones be errected over the graves of my deceased wife Magdalena, and myself to mark our graves.
And lastly, I nominate constitute and appoint my three sons, Joshua, Reuben and Lewis to be the executors of this my will, hereby revoking all other wills, legacies and bequests, by me heretofore made, and declaring this and no other to be my last will and testament. In witness whereof I have hereunto set my hand and seal, this third day of November, AD. Eighteen hundred and eighty (1880).

[Page 1] Distribution in Re Estate of Daniel Riegel, deceased.
Daniel Riegel died January 20th, 1881. He had issue twelve children, eight of whom were living at the time of his death, to-wit: Joshua, Lewis, Reuben, Hannah Neiswender, Catharine Smith, Susannah Deibert, Elizabeth Gerber, and Mary Matilda Herman; - The four following having died prior to decedent, to-wit: Lydia Schell, Priscilla Smith, Daniel Riegel and Elias Riegel. These were all children with a former wife; the decedent having shortly before his death married a second wife, with whom however he had no issue. The fund for Distribution arises from money remaining in certain real estate formerly the property of decedent and upon which the decedent's widow received interests until her death a few months ago.
The list of heirs is as follows:-
I. - Joshua Riegel, a son, who died after his father. He had two wives and the following issue:-

III. - Reuben Riegel, - a son, living. He assigned his share to Lewis Riegel. - See assignment. Lewis Riegel having since died bequeathed this share to his wife, Syletta, (See Will.)
IV. - Hannah Neiswender, wife of George Neiswender, a daughter. She is dead, died after her father Daniel Riegel. She died testate and her will is duly probated. Her husband George Neiswender is still living. Left issue as follows:-
Aaron, (living. He assigned his interest to William Kemmerling, (See Assignment).
Helen Kunkel, still living, she assigned her share to George Neiswender, who re-assigned same to Edward C. Riegel, (see Assignment).
Clara Kauffman, - dead, died after her mother Hannah Neiswender, Her husband Emanuel Kauffman is still living. Left issue as follows:-

Mary Matilda Herman assigned all her interest to her one daughter, Mary Gangloff (See Assignment) (The other children of decedent are therefore not mentioned here). She died testate and her will is duly probated.
IX. - Lydia Schell, a daughter, died before her father, Daniel Riegel. but does not take anything, wife not being seized. Her husband Jacob Schell is still living. Left issue as follows:-

[Page 4] XI. - Daniel Riegel, - a son, dead, died before his father Daniel Riegel. He left a widow Susanna (not entitled to share, since husband was not seized) left issue as follows:-

Mary Matilda Riegel. Neither the decedent's widow, nor the two children have been seen or heard from for a period of over thirty years. The other heirs in this estate have concluded they are dead. Their last known address in 1880 was Steamboat Rocks, Iowa. I have sent registered letters there, but they were returned. I also made inquiry from the County Clerk and the Postmaster, but they know nothing about these parties at all in their community. In the light of these facts and since the amounts coming to them are so small, the other heirs in this estate request the Court to distribute this money to them.
XII. - Elias Riegel, - a son dead, died before his father, Daniel Riegel, his wife also is dead. Elias Riegel left to survive him one child, a daughter, Drusilla, who afterward married Elias Heiney. Drusilla Heiney is also dead; she died after her father Elias, and left to survive her a daughter, Mary Heiney. Elias Heiney, the husband is also living. Drusilla Heiney died however before her Grand-father, Daniel Riegel, so that her entire share passes to her daughter, Mary Heiney. Her husband, Elias Heiney, cannot share since his wife Drusilla was never seized of an estate.
13. Orphan's Court on 19 Nov 1904 in Pottsville, Schuylkill, Pennsylvania, United States. 12 IN THE ORPHANS' COURT OF SCHUYLKILL COUNTY, To the Honorable P. M. Dunn, President Judge of the said Court:\emdash The petition of Susanna Deibert, Sylletta Gerber, Executrix of the estate of Lewis Reigel, deceased, John A. Gerber, administrator of the estate of Elizabeth Gerber, deceased, Charles F. Rapp, executor of the estate of Hannah Neischwender, deceased, and Mary Gangloff, respectfully represents:\emdash That Daniel Reigel, late of the Township of West Brunswick, Schuylkill County, deceased, died on the 20th day of January, 1881, seized in his demesne as of fee of and in certain real estate, situate in the Township of West Brunswick in said County, a portion of which said real estate is hereinafter more fully described; That on the 8th day of October 1881 Joshua Reigel and Lewis Reigel, children and heirs of said Daniel Reigel, deceased, presented a petition to the Orphans' Court of said County, praying for a partition of the real estate of said deceased; That in pursuance and by virtue of a decree of said Court in partition of the real estate of the said Daniel Reigel, deceased, Purpart No. 2. Bounded and described as follows, to-wit:\emdash All that certain tract or piece of land, situate in West Brunswick Township, Schuylkill County, Pennsylvania, adjoining lands of Alfred Smith, George Adam, Levi Reigel, Martin Schaeffer, James Seigfried and others, containing forty-four acres more or less, with the appurtenances thereunto belonging, having been refused by the heirs, was ordered and directed to be sold by the executors of said estate, who exposed said real estate to public sale and sold the same to Elias Reigel of North Manheim Township in said County for Eighteen hundred and thirty dollars, which sale was confirmed by the Court on the 24th day of April 1882; That the said court ordered and directed that said tract or Purpart No. 2 be sold "subject to the payment of the interest of seven hundred and forty dollars, at the rate of six percent payable semi-annually, to be and remain in said purpart No. 2, according to the tenor of an ante-nuptial contract and will" which said ante-nuptial contract was dated the 13th day of November, 1878, and recorded in Schuylkill County, in the Recorder's Office, in Miscellaneous Book No. 15, page 659, and which said ante-nuptial contract sets forth that the sum of Two thousand dollars was to remain in the real estate of the said Daniel Riegel for and during the natural life of the said Lydia Weaver, afterward Lydia Riegel, and of which amount seven hundred and forty dollars was by the Court's decree ordered to remain in said purpart No. 2.
