Couple's lawyer threatens lawsuit.

Montour Township daycare center operators John and Carol Balllet have been cleared of child abuse charges following a four-month investigation by the Columbia County district attorney and township police.
"The completed Investigation has failed to disclose evidence upon which criminal charges may be filed" said a statement released Wednesday by DA Elwood Harding and township Police Chief Robert Leighow.
"Therefore no prosecutions will be initiated from this investigation," the statement said.
The abuse charges and a charge of operating a daycare center without a license were lodged by the Department of Public Welfare through the state Attorney General's office in April and the center was closed.
John Balliet declined comment on the completed probe last night but the couple's attorney Michael Lynn of Bloomsburg reacted angrily and threatened suit against those for the charges.
"My clients," Lynn said "went through their share of hell."
"Normally the way the system Is supposed to work, and I do have more than a working knowledge of it, is for a thorough investigation to be made and then charges, if any are warranted, are made."
In the Balliets' case, the state asked Commonwealth Court to close the center while the alleged abuse was investigated.
Lynn also questioned whether the state overstepped its bounds and went beyond the 30 days allowed by law for such Investigations.
"After a certain point it became a fishing expedition, a treasure hunt as the state dragged the investigation out searching for something, anything," he said.
Lynn said there are certain procedural problems involved with suing the state, "but anticipating this outcome, I've been Investigating those procedures for about two months.
"We're also checking the role of Columbia County Children and Youth Services and some specific individuals in this whole affair," he said. He did not name the individuals.
"We're taking a very serious look at all the events that led up to this Investigation," Lynn said.
Lynn said he and his clients believe the charges were filed in retaliation for the Balliets' decision not to care for foster children any longer.
Of the license, Lynn said his clients knew for years that they did not have the proper papers, "but had been told not to worry about It by Children's Services officials.''
Only after the Balliets of 138 Sunken Heights Ave decided to stop taking care of foster children did the license become an issue, he said.
Joan Mosier, head of Children and Youth Services, declined to comment on any of Lynn's allegations last night because of confidentiality laws, she said.
Lynn said the cloud created by the allegations had repercussions for his clients and the parents who took their children to the center.
"Many of those parents, working parents, were forced to look elsewhere for daycare even though they trusted Carol. And some of them could not find it," Lynn added.
In April, the Balliets reached a settlement with the Welfare Department allowing them to care for up to three children at their home, provided they told parents they were being investigated for child abuse.
The state had alleged that at least three children were sexually abused, including two foster children.
Carol Balliet was accused of having sexual contact with a 4-year-old boy under her care and of requiring the child to take naps with her while both were nude.
Also, the Balliets took pictures of their foster children, ages 3 and 4, in the nude, and the younger child saw or participated in sexual intercourse, the state alleged.
Lynn said he believes the conclusion of the local probe ends any state investigation as well. No Welfare Department spokesman could be reached for comment last night.

John J. Balliet, 59, a 20-year resident at 138 Sunken Heights Ave., Bloomsburg, died Saturday evening at Geisinger Medical Center. Born Dec. 23, 1932 in Shenandoah, he was the son of the late John A. and Evelyn E. Beacher Balliet. He worked in the tool and gauge department of Textron for 33 years. Mr. Balliet was a graduate of the West Mahoning Township High School and attended Penn State University. He was a veteran of the Army. He was a member of the Good Shepherd United Methodist Church. Mr. Balliet was a member of the American Legion Odd Fellows Rescue Hook and Ladder Company and the Masonic Lodge, all of Shenandoah. Surviving are his wife of 32 years, the former Carol A. Buckenberger; five daughters: Judy A. Heddens, Elysburg; Jill A. Balliet, Danville and Jennifer A., Jamie A., and Jessica A. Balliet, all at home. Services will be held Tuesday at 10 a.m. from the Allen Funeral Home, 745 Market St., Bloomsburg, with the Rev. Nancy Firestone, his pastor, officiating. Burial will be in the New Rosemont Cemetery.
